Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ThinqRx platform at https://www.thinqrx.in (the “Platform”), operated by Thinqr (OPC) Pvt Ltd (“Company,” “we,” “us,” or “our”), a company incorporated under the laws of India.

By creating an account or using the Platform, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. About the Platform

ThinqRx is an AI-powered educational platform designed for pharmacy students preparing for GPAT (Graduate Pharmacy Aptitude Test) and related entrance examinations. The Platform provides:

1. AI-generated study notes and summaries;
2. Practice tests and full-length CBT-format mock tests;
3. Performance analytics and progress tracking;
4. Subject-wise and topic-wise study material based on the PCI syllabus.

2. Eligibility

1. You must be at least 18 years old, or at least 16 years old with verifiable parental/guardian consent, to use the Platform.
2. By registering, you represent that all information you provide is accurate, current, and complete.
3. You are responsible for maintaining the confidentiality of your account credentials.

3. Account Registration and Security

1. You must provide a valid email address and create a password to register.
2. You are solely responsible for all activity that occurs under your account.
3. Each account is limited to a maximum of 2 (two) devices. Access from additional devices will be restricted. Device usage is tracked via encrypted device fingerprinting.
4. You must not share, sell, or transfer your account to another person.
5. You must notify us immediately at info@thinqrx.in if you suspect unauthorized access to your account.
6. We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice.

4. Subscription Plans and Payments

4.1 Plans

The Platform offers the following subscription plans (subject to change):

• Free Plan: Limited access at no cost.
• Plus Plan: Enhanced access for a monthly fee.
• Pro Plan: Full premium access for a monthly fee.
• Exam Packs: Specialized plans (e.g., GPAT Last Minute Pack, GPAT 2027 Full Prep) with varying prices and validity periods.

Current pricing, features, and validity periods are displayed on the Platform's pricing page and are subject to change at the Company's discretion.

4.2 Payment Processing

1. All payments are processed securely through Razorpay, a PCI-DSS compliant payment gateway.
2. All plans are one-time payments. There are no auto-renewal or recurring charges.
3. Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
4. A payment is considered complete only after successful verification of the Razorpay payment signature.

4.3 Plan Activation

1. Your subscription plan is activated immediately upon successful payment verification.
2. Validity begins from the date of activation and expires after the plan's specified duration.
3. Expired plans revert to Free Plan access. No data is deleted upon expiry.

5. AI-Generated Content Disclaimer

1. Study notes, summaries, and certain test content on ThinqRx are generated using artificial intelligence (OpenAI).
2. While we strive for accuracy, AI-generated content may contain errors, omissions, or inaccuracies.
3. AI-generated content is intended as a supplementary study aid and should NOT be treated as a substitute for textbooks, official study material, or professional academic guidance.
4. The Company does not guarantee that using the Platform will result in passing any examination.
5. Users are advised to cross-reference AI-generated content with authoritative academic sources.

6. Acceptable Use

You agree NOT to:

1. Use the Platform for any unlawful purpose or in violation of any applicable Indian law;
2. Share, redistribute, reproduce, or commercially exploit any content from the Platform, including AI-generated notes and test questions;
3. Attempt to reverse-engineer, decompile, or extract source code from the Platform;
4. Use automated scripts, bots, or scraping tools to access the Platform;
5. Circumvent the 2-device limit or any other technical restrictions;
6. Share your account credentials with others or operate multiple accounts;
7. Upload or transmit viruses, malware, or any harmful code;
8. Interfere with or disrupt the Platform's servers or infrastructure;
9. Impersonate another person or misrepresent your affiliation with any entity.

7. Intellectual Property

1. All content on the Platform — including text, graphics, logos, UI design, software code, AI-generated content, and the “ThinqRx” brand — is the property of Thinqr (OPC) Pvt Ltd or its licensors and is protected under Indian copyright and intellectual property laws.
2. Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform's content for personal, non-commercial educational purposes only.
3. You may not copy, modify, distribute, sell, or create derivative works from any Platform content without prior written consent.

8. Account Suspension and Termination

1. We may suspend or terminate your account at our sole discretion if you violate these Terms, engage in fraudulent activity, or abuse the Platform.
2. Blocked accounts lose access to all Platform features. Data associated with blocked accounts may be retained as required by law.
3. You may request account deletion by emailing info@thinqrx.in. Upon deletion, your personal data will be removed within 30 days, subject to legal retention requirements.
4. Termination does not entitle you to a refund except as provided in our Refund Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

1. The Platform is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.
2. We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or harmful components.
3. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
4. Our total cumulative liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the amount paid by you to us in the 12 months preceding the claim.
5. We are not liable for any academic outcomes, examination results, or career decisions based on the use of the Platform.

10. Indemnification

You agree to indemnify, defend, and hold harmless Thinqr (OPC) Pvt Ltd, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

1. Your use of the Platform;
2. Your violation of these Terms;
3. Your violation of any third-party rights;
4. Any content you submit or transmit through the Platform.

11. Governing Law and Dispute Resolution

1. These Terms are governed by and construed in accordance with the laws of India.
2. Any disputes arising from these Terms shall first be attempted to be resolved through amicable negotiation within 30 days.
3. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts in Kakinada, Andhra Pradesh, India.

12. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, internet outages, cyberattacks, or third-party service provider failures.

13. Modifications to Terms

1. We reserve the right to modify these Terms at any time. The updated version will be indicated by the “Last updated” date.
2. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
3. Material changes will be communicated via email or a prominent notice on the Platform.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Thinqr (OPC) Pvt Ltd regarding the use of the Platform.
